Fast Forward is a payment option available at participating Safeway stores. By enrolling in Fast Forward, you can add payment functionality to your Safeway Club Card. This will allow you to receive all of your Club savings, and pay for your groceries directly from your checking account at the same time.
You can pay by using your new Fast Forward card and PIN, just like with a debit card. But unlike a debit card, you also have the option to pay without your card (cardless) by simply using your 10-digit Cardless Access Number (e.g., your telephone number) and PIN.
Your Fast Forward enabled Club Card is linked to your existing checking account at the financial institution of your choice. There is no need to set up a new checking account. During the enrollment process you will be asked to provide your bank routing number and account number from your checking account.
There are two ways to enroll.

When you have successfully enrolled, look for your Fast Forward Debit Card and PIN to be mailed separately within 7 to 10 days. The first time you use Fast Forward in our participating stores, you will need to use a standard checkout lane (not a self-checkout or a kiosk) and bring your driver's license for security and verification purposes.
Safeway does not currently assess a fee for using the Fast Forward Service. However, there may be other fees imposed by other parties. For more information, please refer to the Fast Forward Terms and Conditions and Electronic Consent Agreement.

Because Fast Forward works like a check, the funds for each transaction may take several business days after the transaction occurred to be withdrawn from your Checking Account; however funds need to be immediately available in your account.
In the event that you have forgotten your PIN, contact Payment Services at 1-866-392-9517 or write to them at P.O. Box 29241, Phoenix, AZ 85038. A new PIN will be generated and sent to you via US Postal Service in approximately 7 to 10 days. Please remember to safeguard your PIN. Never share, or write your PIN on or near your Fast Forward card.
Once you have successfully received your Fast Forward Debit Card and PIN by mail, you may contact Payment Services at 1-866-392-9517 where you can update your PIN to a PIN of your choice using our automated PIN set system.

Yes. You may cancel your account at any time by contacting Payment Services at 1-866-392-9517 or by writing to them at P.O. Box 29241, Phoenix, AZ 85038. Safeway also reserves the right to terminate the Fast Forward Service, under certain circumstances. For more information, please refer to the Fast Forward Terms and Conditions and Electronic Consent Agreement.
No. Your card and your cardless number do not expire.
You will not receive a separate statement tracking your Fast Forward transactions. The transactions will appear only on the statement issued by your financial institution that holds the account you used to enroll in Fast Forward. You should save the receipts you are given when you use Fast Forward if you wish to check them against the account statement you receive from your bank that holds your account.

You can only complete your enrollment with your banking information.
You will be issued a new Safeway Club Card account already linked to your new Fast Forward account to ensure that you receive your Club Card savings each time you pay with Fast Forward.
Please Note: If you are currently using just for U™ digital savings or have any other promotions or benefits tied to your existing Club Card account, you will need to link your existing account to your new Club Card account. This can easily be done during enrollment by providing your existing Club Card number or the current Club Card linked phone number.
You can also call Safeway at 1-877-723-3929 to link your accounts later, after successful enrollment. You will be asked for your Fast Forward Cardless and Card Reference number. Be sure to provide the Cardless Number you created during enrollment. For security reasons, if your online enrollment via www.safeway.com/fastforward is idle for more than 10 minutes, it will be automatically canceled. You will need to restart from the beginning if your enrollment process expires.
No. Your initial Fast Forward activation (with Driver's License or ID swipe) must be performed at a register located at the front of the store or at the Customer Service register inside the main store. Initial activation also cannot be processed at Self-Checkout or store department registers.
Yes, once you are fully authorized to use the Fast Forward Service, you can get a maximum cash back amount of $100 in a single day and up to $300 in a 3-day period. If your enrollment is conditional pending additional processing, cash back is not allowed until after your application review is completed and your enrollment is fully authorized. Cash back goes towards your Purchase Amount Limits, and is not in addition to your Purchase Limits. For more information, please refer to the Fast Forward Terms and Conditions and Electronic Consent Agreement.
Once you are fully enrolled into the Fast Forward Service, a request can be made to increase your limits by contacting Payment Services at 1-866-392-9517. Certain restrictions may apply.
You will have a better enrollment experience using a desktop or laptop computer, or you can call Payment Services to enroll by phone at 1-866-392-9517. However to enroll for Fast Forward online using a mobile device (e.g. iPhone, Android, Blackberry), you must have the Safeway App installed.

You will be able to redeem up to $1 per gallon in Gas Rewards approximately 10 days after you activate your Fast Forward card in-store. You can redeem your Rewards at any participating Chevron and Texaco station (not just in California).
For customers who successfully activated their Fast Forward card prior to March 26, 2014, the added benefit of redeeming up to $1 per gallon at Chevron and Texaco stations is effective immediately.
Gas Reward Points earned by paying with Fast Forward expire based on the same rules as the current Safeway Gas Reward Points Program. You agree that, as a user of Fast Forward to comply with this Agreement. Participation in the Service is offered at the discretion of Safeway and may be withdrawn by Safeway in its discretion. Please read this Agreement carefully before participating in the Service. If at any point you do not accept any of the terms and conditions of this Agreement, or are no longer satisfied with the Service, your sole remedy is to end your participation in the Service. You may not use the Service for commercial purposes, or in any way that harms Safeway or any other person or entity, as determined by Safeway in its sole discretion.
By enrolling for the Service, you consent and unconditionally agree to: (a) having your checking account designated in your enrollment (your "Affiliated Account") debited electronically to pay for purchases you initiate through the Service and any other applicable fees and charges; (b) electronically signing our Fast Forward Payment Authorization Agreement; (c) using an electronic signature that evidences your identity; (d) Safeway obtaining personally identifiable information from you and sharing it with its third-party service provider to authenticate your identity and provide verification and validation services in connection with your enrollment and use of the Service and as allowed by law; (e) Safeway electronically confirming that you meet our minimum system requirements; and (f) to the extent allowed by law, receiving all required disclosures, notices and statements, including any changes in terms, in electronic form by either downloading such documents to your personal computer or by viewing them as posted on a Fast Forward enrollment web site.
You understand and agree that we may electronically provide to you, or in our sole discretion mail to you, certain documents for your enrollment in and use of the Service as well as disclosures, notices and statements regarding the debiting or crediting of your checking account, your use of the Service, your relationship with us, and/or other programs, products or services that are or may in the future be made available to you ("Communications"). Such Communications may include, but are not limited to: (a) this Fast Forward Terms and Conditions and Electronic Consent Agreement; (b) the Fast Forward Payment Authorization Agreement; (c) periodic disclosures or notices relating to any purchases/ payments initiated through the Service, account debits and credits, and services we offer or render including but not limited to any statement, notice or communication that may be required by the Electronic Fund Transfers Act, the Gramm -Leach Bliley Act, or other applicable laws and regulations; (d) any notice or disclosure regarding the imposition of a fee for the Service or any notice or disclosure regarding the imposition of any fee for an electronic debit returned for any reason, such as insufficient funds or as a result of a stop payment order; (e) any change-in-terms of the terms, conditions or rules applicable to the Service; (f) privacy statements or notices; and (g) certain statements that we are legally required to provide to you.
To enroll for the Service through the Internet at a terminal which is not in a participating Safeway Store, you must have: (a) a personal computer ("PC"), tablet with PC, or mobile device (e.g. iPhone, Android, Blackberry) with browser based Safeway App installed; (b) one of the following Internet Browsers on your PC, any of which supports HTML 4.0 and SSL encryption (i) Microsoft Internet Explorer 8.0 or later versions or (ii) Mozilla Firefox, latest auto-upgrade version or (iii) Google Chrome, latest auto-upgrade version or (iv) Safari v5.1; (c) a printer connected to your PC or sufficient hard-drive space (approximately one megabyte) to download and save the Communications; and (d) Internet access via dial-up, DSL, Cable Modem, Wireless Access Protocol, or equivalent that supports your electronic access to the Fast Forward enrollment web site.
You acknowledge, represent and warrant that by agreeing to this Agreement and Electronic Consent through a Fast Forward enrollment web site, you reasonably demonstrate that you can access Communications that we electronically provide to you. By clicking on the "I Agree" button or similar buttons on the web site, you are stating that you are currently accessing this web site with a computer system, Internet access, browser and printer (or other storage device) that allows you to transmit, receive and retain the Communications.
You may withdraw your consent to receiving Communications electronically by providing notice of your withdrawal of such consent to us, in writing, at Payment Services, P.O. Box 29241, Phoenix, Arizona 85038-9241, and identifying yourself by first name, last name, and state issued identification or driver's license used to enroll in Fast Forward. Such withdrawal will become effective after we have had a reasonable amount of time to act upon it. Your consent shall remain in force until withdrawn in the manner provided in this paragraph.
You may obtain a paper copy of your Fast Forward Payment Authorization Agreement and any legally required Communications for up to 12 months after you execute them or they have been provided or made available to you electronically. You may request such a paper copy by writing to us at Payment Services, P.O. Box 29241, Phoenix, Arizona 85038-9241. Be sure to specify your name and the address to which it should be mailed. We do not currently impose a fee if you request a paper copy, although we retain the right to charge fees at a later date for such a copy if we provide you with a notice of such a change-in-terms, either through an e-mail to you or by making such a change-in-terms available at a Fast Forward enrollment web site or through any other notice as required by law.
All Communications in electronic format provided to you by us will be considered written communications. You should print, download and/or retain a copy of this Fast Forward Terms and Conditions and Electronic Consent and the Fast Forward Payment Authorization Agreement and any other Communications that you execute or we provide or make available to you electronically, for your permanent records.
If you are enrolling for the Fast Forward Service at a participating Safeway Store, we will send you a copy of the terms and conditions in effect at the time of your enrollment, and can provide you with a copy of your Fast Forward Payment Authorization Agreement promptly upon request.
When you enroll for the Fast Forward Service via the telephone, you consent to: (a) having your Affiliated Account debited electronically to pay for purchases you initiate through the Service and any other applicable fees and charges; (b) verbally agreeing to the Fast Forward Terms and Conditions over the telephone; and (c) Safeway obtaining personally identifiable information from you and sharing it with its third-party service provider to authenticate your identity and provide verification and validation services in connection with your enrollment and use of the Service and as allowed by law.
To enroll by telephone, you must have a telephone system that allows you to input digital signals (also known as a touch-tone phone). When you call us to enroll for the Fast Forward Service, you are confirming your intent to enroll by telephone and reasonably demonstrating that you can communicate by telephone for the purposes of the enrollment process.
If you are enrolling by telephone for the Fast Forward Service, we will send you a copy of the terms and conditions in effect at the time of your enrollment when we send you the Fast Forward Card that is issued to you ("Card"). We can also provide you with a copy of your Fast Forward Payment Authorization Agreement upon request. You may request such a copy by writing to us at Payment Services, P.O. Box 29241, Phoenix, Arizona 85038-9241. Be sure to specify your name and the address to which it should be mailed. We do not currently impose a fee if you request a copy, although we retain the right to charge fees at a later date for such a copy if we provide you with a notice of such a change-in-terms as required by law.
By applying for Fast Forward, you agree to join the Safeway Club to receive your Club Card savings. Safeway respects your privacy and does not sell or lease personally identifying information (i.e., your name, address, and telephone number) to non-affiliated companies or entities. Safeway does record information regarding the purchases made with your Safeway Club Card to help provide you with special offers and other information. Safeway also may use this information to provide you with personally tailored coupons, offers or other information that may be provided to Safeway by other companies.
By opting-in to link your new Club Card account to your pre-existing Club Card account, you agree that Safeway use the new information in connection with your Club Card account.
We do not require you to link your new Club Card account to your pre-existing Club Card. Card linking is subject to accurate record identification and approval.
Before you may use Fast Forward you must be approved. Your Fast Forward Debit Card will usually arrive in the mail within ten business days. Your PIN will usually arrive separately within ten business days. In order for you to perform a transaction involving Fast Forward, you must either: (a) use the Fast Forward Card that is issued to you and enter your PIN; or (b) input your ten (10) digit cardless access number ("Cardless Number") and PIN (referred to as "Cardless Transaction"). If you forget your PIN or Cardless Number, you will need to call us to apply for a new PIN or Cardless Number. Please call us at 866-392-9517 if you need to apply for a new PIN or Cardless Number, or if you want to cancel your Fast Forward Card or Service.
You may use Fast Forward, subject to certain limits, to pay for purchases at participating Safeway Stores or to withdraw cash ("Cash-Back") at participating Safeway Stores from available funds in the Affiliated Account designated in your enrollment. Under certain circumstances, your enrollment may be conditional pending processing of your application. During such conditional enrollment, all of the following limits will apply: (a) there is a limit of three transactions in any three-day period; (b) you may buy up to One-hundred and Fifty Dollars ($150) worth of goods or services in any such single transaction; (c) there is no cash-back allowed; (d) there is a maximum pre-authorization (for e.g. fuel pump transactions) amount of One-hundred and Twenty-Five Dollars ($125) in any three-day period. After we complete our review of a conditionally enrolled application, we will either make you fully authorized for all Fast Forward transactions, or we may decline to provide further services and terminate your Fast Forward access. Please call 866-392-9517 ten (10) days after your conditional enrollment to check the status of your enrollment. The following limits and restrictions apply to Fast Forward once you are fully authorized to use the service: (a) there is a limit of five transactions per day and a total of ten transactions in any three-day period; (b) you may buy up to Four-Hundred Dollars ($400) worth of goods or services in a single day and up to a total of Seven-hundred Dollars ($700) in any three-day period; (c) there is a maximum cash-back amount of One Hundred Dollars ($100) in a single day and up to a total of Two-hundred Dollars ($200) in any three-day period; (d) there is a maximum pre-authorization amount (for e.g. fuel pump transactions) of One-hundred and Twenty-Five Dollars ($125) in a single transaction with a maximum of Two-hundred and Fifty Dollars ($250) in a single day and up to a total of Three-hundred and Seventy-Five Dollars ($375) in any three-day period. We may change these limitations and restrictions in our sole discretion, including but not limited to lowering or increasing these limits. We reserve the right to refuse a transaction involving Fast Forward or to terminate your right to use Fast Forward at any time in our sole discretion, including but not limited to where we believe that the transaction may not be authorized, may be disputed, may be erroneous or that you may not have sufficient available funds in your Affiliated Account for the transaction. Your financial institution may impose additional restrictions and limitations. If the Affiliated Account number changes, or your Affiliated Account is changed from a checking account to a savings account, or if the Affiliated Account becomes inactive or is closed, you agree to notify us immediately by calling us at 866-392-9517 and to immediately discontinue using the Fast Forward Card and Service.
We reserve the right in our sole discretion to set additional limits on the Fast Forward Service, including but not limited to changing the dollar amount of goods and services that may be purchased and the cash-back amounts that can be obtained through the use of Fast Forward. We may change such limits as we deem necessary, and will provide you with notice of such change in terms as required by law.
You confirm that during the Enrollment process you agreed that you were providing written instructions to us authorizing us to obtain from a consumer reporting agency or other third party your personal identification profile or other information. You also confirm that you authorized us to debit (or credit, if applicable) the Affiliated Account to pay for transactions done using your Fast Forward Card, PIN, or that were done through a Cardless Transaction. You confirm that you properly identified the financial institution that holds the Affiliated Account; that it is your Affiliated Account and you are an authorized signer on it; that the number of the Affiliated Account and routing number on the Affiliated Account are the correct numbers for the Affiliated Account; and you are authorized to sign the Affiliated Account up for the Fast Forward Service, and your agreement to do so also constitutes the agreement by any authorized signers on the Affiliated Account.
You can get a receipt at the time you make any purchase or cash withdrawal using your Fast Forward Service. This receipt will also contain our address and telephone number to be used for inquiries, error notices, PIN changes, and for reporting loss or theft of the Card or Cardless Number. We will not send you a periodic statement listing transactions that you make using your Fast Forward Service. The transactions will appear only on the statement issued by your financial institution that holds the Affiliated Account. For the purposes of this Agreement and these disclosures, our business days are Monday through Friday, excluding holidays.
Federal law provides that, if we do not complete a Payment Order to or from your Affiliated Account in the correct amount according to our agreement with you, we will be liable for your losses or damages. There are, however, some exceptions. We will not be liable, for instance, if: (a) through no fault of ours you do not have enough available funds in your Affiliated Account (or available credit in your overdraft protection account, if applicable) to make the transfer; (b) circumstances beyond our control (such as fire, flood, water damage, power failure, strike, labor dispute, computer breakdown, telephone line disruption or a natural disaster) prevent or delay the transfer despite reasonable precautions taken by us; (c) the system or point-of-sale terminal was not working properly and you knew about the problem when you started the transaction; (d) we have reason to believe the transaction may not be authorized (e.g. if your Card, PIN or Cardless Number is reported lost or stolen); (e) the information supplied by you or a third party is incorrect, incomplete, ambiguous or untimely; or (f) the transaction cannot be completed because your Card is damaged, your PIN is wrong, or the information you provide in a Cardless Transaction is not correct.
Tell us AT ONCE if you believe your Card, PIN or Cardless Number has been lost or stolen. Telephoning is the best way to notify us and to minimize potential losses. If you fail to contact us, you could lose all the money in your Affiliated Account, plus your maximum overdraft line of credit. If you tell us within four business days, you can lose no more than $50.00 if someone used your Card or did a Cardless Transaction without your permission.
If you do not tell us within four business days after you learn of the loss or theft of your Card, PIN or Cardless Number and we can prove we could have stopped someone from using your Card or doing a Cardless Transaction without your permission if you had told us, you could lose as much as $500.00.
If your Affiliated Account statement shows transactions or transfers you did not make involving your Card, PIN or Cardless Number, also tell us at once. If you do not tell us within ninety (90) days after the Affiliated Account statement was mailed to you, you may not get back any money you lost after the ninety (90) days, if we can prove we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, or the delay in notifying us was due to the fact that you initially notified the financial institution holding your Affiliated Account, then we will extend the time period by a reasonable period of time.
If you furnish the Card, PIN or Cardless Number and grant authority to make a transfer to someone who exceeds the authority given, you will be fully liable for the transfers made by that person until you notify us and the financial institution that holds your Affiliated Account that such person is no longer authorized to make transfers. Under such circumstances, you may be required to change your Cardless Number and/or PIN.
If you believe YOUR CARD, PIN OR CARDLESS NUMBER IS LOST OR STOLEN, OR THAT SOMEONE HAS MADE OR MAY MAKE A PURCHASE OR CASH WITHDRAWAL FROM YOUR ACCOUNT BY USING YOUR FAST FORWARD CARD OR DOING A CARDLESS TRANSACTION WITHOUT YOUR PERMISSION, OR IF FOR ANY OTHER REASON YOU WOULD LIKE TO CHANGE YOUR PIN, NOTIFY US AT ONCE AT 866-392-9517 OR WRITE US AT PAYMENT SERVICES, P.O. BOX 29241, PHOENIX, AZ 85038-9241.
ALL QUESTIONS ABOUT TRANSACTIONS MADE WITH YOUR FAST FORWARD CARD OR DONE THROUGH A CARDLESS TRANSACTION MUST BE DIRECTED TO SAFEWAY. Safeway is responsible for the Fast Forward Service and for resolving any errors in transactions made with your Fast Forward Card or done through a Cardless Transaction.
In the case of errors or questions about transactions involving your Card, PIN or Cardless Number, or if you would like to change your PIN, or if you need more information about a Fast Forward transaction listed on your receipt or the statement you receive from the financial institution that holds your Affiliated Account, or if you think your receipt or Affiliated Account statement is wrong regarding a transaction involving your Fast Forward Card or a Cardless Transaction, then call us at 866-392-9517 or write to us at Payment Services, P.O. Box 29241, Phoenix, AZ 85038-9241, as soon as you can. We must hear from you no later than ninety (90) days after the date of the FIRST Affiliated Account statement on which the problem or error appeared.
When you contact us, please: (1) tell us your name, Affiliated Account number, Card number, Cardless Number, and (if applicable) your driver's license number or state identification card number; (2) describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; (3) tell us the dollar amount of the suspected error; and (4) if you tell us orally, we may require that you send us your complaint or question in writing within 10 days.
We will inform you the results of our investigation within ten business days after your notification, and will correct any error promptly. If we need more time, however, we may take up to ninety (90) days to investigate your complaint or question. If we decide to do this, we will credit your Affiliated Account or issue you a provisional refund within ten business days for the amount you think is in error, so that you will have use of the money while we complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within ten business days, we may not credit your Affiliated Account.
We will tell you the results of our investigation within three business days after we complete our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
SECTIONS 6.4, 6.5 AND 6.7 OF THIS AGREEMENT APPLY ONLY IF YOU ARE A NATURAL PERSON AND THE ACCOUNT WAS ESTABLISHED PRIMARILY FOR PERSONAL, FAMILY OR HOUSEHOLD PURPOSES.
Although Safeway does not currently assess a fee for using the Fast Forward Service, there may be other fees for each transaction performed using a Fast Forward Card, or done through a Cardless Transaction including, without limitation, fees imposed by transaction processing services and card network providers. In addition, the financial institution which holds the Affiliated Account and any company or institution that owns or operates the point-of-sale machine may assess additional fees and surcharges.
We collect nonpublic personally identifiable information about you from the following sources: (a) information we receive from you on Enrollment applications or other forms; (b) information about your transactions with us, our affiliates or others, and (c) information we receive about you from third parties, including but not limited to consumer reporting agencies. We will disclose information to our affiliates and to third parties about your transactions involving your Card, PIN, or Cardless Transactions: (a) where it is necessary to complete the transaction; (b) in order to authenticate your identity or verify the information on your Affiliated Account; (c) if you have chosen to link your Fast Forward account to the Safeway Club Card, in order for Safeway to link your Fast Forward account to your Safeway Club Card and to update your Safeway Club Card data; (d) in order to comply with government, supervising agency or court orders or other legal requirements; (e) in response to legal process; (f) to consumer audit bureaus; (g) as legally permitted; or (h) if you give us written permission. We may disclose your personally identifiable information to our affiliates or to companies that perform marketing services on our behalf or to financial institutions with which we have joint marketing agreements, or as otherwise permitted by law. We may also share information about our experiences or transactions with you or your Fast Forward Services, Card, PIN, or Cardless Transactions with our affiliates or subsidiaries.
In processing your transactions involving your Card, PIN or Cardless Number, we restrict access about your nonpublic personally identifiable information to those employees and agents who need to know such information to help us provide the Fast Forward Service to you. We maintain physical, electronic and procedural safeguards that comply with federal standards to guard your nonpublic personal information.
We may modify or delete any of the terms of this Agreement, provide you with other communications, or we may add additional terms at any time by electronic notice or to the extent required by law by mailing a notice to you at your last address shown on our records for the Card at least twenty-one (21) days before the changes are to become effective, except that changes may be made without prior notice if they are necessary to maintain or restore the security of your Affiliated Account, Safeway's systems, or its agent's systems. We will notify you within thirty (30) days after such change is made permanent, unless we determine such change must remain confidential to maintain the security of the systems and/or your Affiliated Account. If you continue to participate in the Service by using your Card, PIN or Cardless Number, or in any other way after this Agreement has been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes.
The Card, PIN and Cardless Number are the property of Safeway. We may, at our option, suspend or terminate your right to use the Fast Forward Service, the Card, PIN, or ability to do Cardless Transactions at any time, for any reason, in our sole discretion. We may at our option suspend or terminate any conditional enrollment and your right to use the Fast Forward Service, the Card, PIN or ability to do a Cardless Transaction at any time for any reason, in our sole discretion. You may terminate your use of the Fast Forward Service by giving us written notice at Payment Services, P.O. Box 29241, Phoenix, AZ 85038-9241 or by calling us at 866-392-9517. Your obligation to pay all overdrafts and other amounts you may owe us shall not be released or otherwise affected by termination or cancellation of your right to use the Fast Forward Service, Card, PIN, or your ability to do Cardless Transactions. Our obligation under this Agreement to honor a Fast Forward Card, PIN, or a Cardless Transaction ends when your right to use the Fast Forward Service Card, PIN, or ability to do a Cardless Transaction is terminated or canceled. You agree not to use the Fast Forward Service or Card or do a Cardless Transaction after your Fast Forward Service or Card or ability to do a Cardless Transaction has been terminated or canceled for any reason or while it is suspended, and you agree to return the Card (cut in half) to us immediately if the Fast Forward Card or Service is terminated or canceled.
You agree to pay all reasonable expenses we may reasonably incur: in collecting any amount owed by you to us under this Agreement; in retrieving the Card; and/or in enforcing our rights under this Agreement (whether or not a lawsuit is filed).
You agree to notify us in writing at Payment Services, P.O. Box 29241, Phoenix, Arizona, 85038-9241, or by phone at 866-392-9517 if you change your name, address or other information contained in the Enrollment. You agree to give us any updated information we may request from time to time. You authorize us to confirm and to check from time to time the information you provide to us or we obtain about you, including but not limited to contacting the financial institution that holds your bank account, contacting a consumer reporting agency, or contacting other third parties.
By using the Service in any way, you unconditionally consent and agree that: (1) any claim, dispute, or controversy (whether in contract, tort, or otherwise) you may have against the officers, directors and employees of Safeway and its parent, subsidiaries, affiliates (all such individuals and entities collectively referred to herein as the "Company Entities") arising out of, relating to, or connected in any way with the Service or the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by American Arbitration Association ("AAA") and conducted before a single arbitrator in accordance with the rules of AAA; (2) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16; (3) the arbitration shall be held in Arizona; (4) the arbitrator's decision shall be controlled by the terms and conditions of this Agreement and any of the other agreements referenced herein that the applicable user may have entered into in connection with the website; (5) the arbitrator shall apply Arizona law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only your and/or the applicable Company Entity's individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) the arbitrator shall not have the power to award punitive damages against you or any Company Entity; (8) in the event that the administrative fees and deposits that must be paid to initiate arbitration against any Company Entity exceed $125 USD, and you are unable (or not required under the rules of AAA) to pay any fees and deposits that exceed this amount, Safeway agrees to pay them and/or forward them on your behalf, subject to ultimate allocation by the arbitrator. In addition, if you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Safeway will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor Company shall be entitled to arbitrate their dispute. All fees and expenses of such arbitration proceedings, including both those of the arbitrator(s) and reasonable attorneys' fees and costs for the respective parties to such arbitration, shall be paid by the party against whom the decision or award is rendered as determined by the arbitrator(s).
Safeway, its affiliates, related companies, and their respective officers, directors, employees and contractors (all such individuals and entities collectively referred to herein as the "Released Parties") are not responsible for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. If, for any reason, the Service is not capable of operating as anticipated, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Safeway which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Service, Safeway reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Service program or otherwise respond to the circumstances as Safeway deems appropriate. In the event Safeway is prevented from continuing with the Service as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Safeway's control (each a "Force Majeure" event or occurrence), Safeway shall have the right to modify, suspend, or terminate the Service. Safeway, in its sole discretion, reserves the right to disqualify and terminate participation of any member found to be (i) tampering with the operation of the Service (ii) acting in violation of this Agreement (iii) violating the terms of this Agreement or (iv) acting in an unethical or disruptive manner (v) acting with intent to annoy, abuse, threaten or harass Safeway its representatives or any other member in any manner related to the Service.
THE SERVICE, ANY ENROLLMENT THEREIN, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OR GUARANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR NONINFRINGEMENT. SAFEWAY MAKES NO WARRANTY IN ANY RESPECT AS TO ANY SERVICES MADE AVAILABLE AS PART OF THE SERVICE. By participating in the Service, you accept all responsibility for, and hereby release, indemnify and hold the Released Parties harmless from and against any claims that may arise from actions taken by you.
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE SERVICE OR YOUR PARTICIPATION THEREIN. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL THEORY, EVEN IF SAFEWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SAFEWAY'S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
By participating in the Service, you agree to defend, indemnify, and hold harmless Safeway, its affiliates, related companies, and their respective officers, directors, employees and contractors from all liabilities, third party claims and expenses (including reasonable attorney's fees) that arise out of or are related, in whole or in part, to your violation of this Agreement.
This Agreement: (a) does not create any relationship of principal and agent, employer-employee, joint venture, partnership or any association between the parties except as described herein; (b) is for the sole and exclusive benefit of you and Safeway, and nothing contained in this Agreement, whether express or implied, is intended to confer any right, remedy or benefit upon any person or entity other than the parties; (c) does not relieve or discharge any obligation or liability of any third person or entity and does not give any third party any right to subrogation or other action over or against either of the parties; (d) will be governed by and construed under the laws of the State of Arizona. The unenforceability of any provision of this Agreement will not in any way affect or impair the legality or enforceability of the remaining provisions of this Agreement. A waiver or indulgence of any breach of any term, condition, covenant or warranty contained in this Agreement shall not be deemed or construed to be a waiver of any other provisions, nor shall it affect the validity of the remainder of this Agreement, or constitute a waiver of any preceding or succeeding breach of the same or any other provision hereof.
Safeway will impose and may electronically present to your bank the Electronic Funds Transfer Fee set forth below, or the maximum amount allowed by applicable state laws on any Fast Forward transaction that is returned or refused. FOR TELEPHONE ENROLLMENT: BY VERBALLY STATING YOUR CONSENT AND PROVIDING THE REQUIRED INFORMATION BY TELEPHONE YOU AGREE THAT (1) YOU ARE ENROLLING BY TELEPHONE FOR THE SAFEWAY FAST FORWARD SERVICE VIA AN APPROPRIATE TOUCH TONE PHONE SYSTEM; (2) YOU HAVE READ, UNDERSTOOD AND ARE AFFIRMATIVELY AND UNCONDITIONALLY AGREEING TO THE FAST FORWARD TERMS AND CONDITIONS; (3) YOU CONSENT TO THE CHECKING ACCOUNT YOU IDENTIFY IN THE SAFEWAY FAST FORWARD ENROLLMENT PROCESS BEING DEBITED AND, TO PAY FOR THE PURCHASES YOU INITIATE THROUGH THE SERVICE AND ANY OTHER APPLICABLE FEES AND CHARGES; (4) YOUR CONSENT SHALL ALSO CONSTITUTE CONSENT BY ANY AUTHORIZED SIGNERS ON THE CHECKING ACCOUNT YOU IDENTIFY IN THE SAFEWAY FAST FORWARD ENROLLMENT PROCESS; AND (5) YOUR CONSENT REASONABLY DEMONSTRATES THAT YOU CAN COMMUNICATE BY TELEPHONE AND ANY AGREEMENT MADE BY TELEPHONE TO THE FAST FORWARD TERMS AND CONDITIONS OR OTHER LEGALLY REQUIRED DOCUMENTS IS VALID AND BINDING.
What Information We Collect
We may collect "personally identifiable information" about you from the following sources:
Your "personally identifiable information" includes information gathered in the context of providing the Fast Forward service. We receive this information from you during enrollment, from any transactions involving Fast Forward, and that we otherwise obtain about you in connection with providing the Fast Forward service. "Personally identifiable information" does not include any publicly available information or any information that does not identify you.
What Information We Disclose
We are permitted by law to disclose personally identifiable information about you in certain circumstances. For example, we may disclose personally identifiable information about you to affiliated and nonaffiliated third parties to assist us in providing the Fast Forward Service, in response to subpoenas or other legal demands for information or documentation, in response to legal process, to government entities and agencies and to consumer credit bureaus. We may also share information about our experiences or transactions with you or your account with companies related to us by common control or ownership ("affiliates"). We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf or to financial institutions with whom we have joint marketing agreements. We do not disclose any personally identifiable information about you to any other third parties, except as permitted by law.
If you decide to close your Fast Forward account or become an inactive customer, we will continue to adhere to the privacy policies and practices described in this notice.
Important Notice About Credit Reporting
